All persons to whom San Andreas Regional Center (“SARC”) mailed notice that on or about July 5, 2021, SARC was the target of a cyberattack in which third-party criminals gained unauthorized access to SARC’s network, encrypted some of SARC’s systems, and gained unauthorized access to the personal information of consumers (the “Settlement Class”).

A proposed Settlement has been reached in a class action lawsuit against SARC (“Defendant”). The lawsuit asserted claims against the Defendant arising out of or related to a data incident perpetrated on SARC on or about July 5, 2021, in which third-party criminals gained unauthorized access to SARC’s network, encrypted some of SARC’s systems, and gained unauthorized access to the personal information of Plaintiffs and other consumers (the “Data Incident”). SARC denies each and all of the claims and contentions alleged against it in the Litigation.

The Settlement provides for two years of free single bureau credit monitoring and identity theft protection services for all members of the Settlement Class who submit a valid Claim Form. Settlement Class Members who incurred out of pocket expenses as a result of the Data Incident are also eligible to receive monetary benefits for expense reimbursement. If you are a Settlement Class Member, your options are:

SUBMIT A CLAIM

You must submit a valid claim form by no later than April 12, 2023 order to receive a payment or credit monitoring and identity theft protection services from this Settlement.

OBJECT

Write to the Settlement Administrator about why you do not like the Settlement by no later than March 13, 2023, or object orally at the Final Approval Hearing in person or through Microsoft Teams. Please note that you must remain as a Class Member in order to object to the terms of the Settlement.

EXCLUDE YOURSELF

Write to the Settlement Administrator to opt out of the Settlement by no later than March 13, 2023. This is the only option that allows you to be part of any other lawsuit, or your own lawsuit, against the Defendant about the legal claims released in this Settlement.

GO TO A HEARING ON SEPTEMBER 27, 2023

You may object to the Settlement and appear in person or through Microsoft Teams to ask to speak in Court at the Final Approval Hearing about your objection.

DO NOTHING

If you are a Class Member and do not submit a Claim Form, you will not receive a payment and will no longer be able to sue the Defendant over the claims resolved in the Settlement.

The Court must give Final Approval to the Settlement before it takes effect, but has not yet done so.  No payments or Settlement benefits will be issued until after the Court gives Final Approval and any appeals are resolved.
